În contextul dat, discuțiile, controversele şi dezbaterile doctrinare pe marginea subiectelor ce planează în jurul tuturor actelor de gratificare, inclusiv şi a donației, nu vor încetini niciodată, existând atâta timp cât va exista omul, având în vedere că sentimentele de generozitate, caritate, bunătate şi altruism îl vor însoți mereu, atât pe drumul progresului, cât şi pe cel al regresului. În consecință, noțiunea contractului de donație în varianta actuală permite a se înghesui în categoria lui toate actele cu titlu gratuit, precum şi alte fapte de gratificare (cadoul, darurile neînsemnate, reducerile şi discounturile, transplantul de țesuturi şi organe, etc.) care, în genere, ar trebui să fie scoase din câmpul juridic al donației. DISTINGUISHING ACTS OF GENEROSITY AND STIMULATORY ACTS FROM ACTS OF GRATIFICATION CHARACTERISTICS OF THE DONATION RELATIONSHIP Grigore ARDELEAN 1 Ana-Andreea MANEA 2 It has always been natural that the act by which a free act is disposed of, and which may generate certain material consequences towards the donor, should be given increased attention in the regulatory plan, ensuring, in this way, adequate legal protection for the interests that are pursued by concluding the respective contract. In this context, the discussions, controversies and doctrinal debates on the topics that hover around all acts of gratification, including donation, will never slow down, existing as long as man exists, considering that the feeling of generosity, charity, kindness and altruism will always accompany him, both on the path of progress and that of regression. Consequently, the notion of the donation contract in its current version allows to cram into its category all acts with a gratuitous title, as well as other acts of gratification (gift, insignificant gifts, reductions and discounts, transplantation of tissues and organs, etc.) which, in general, should be removed from the legal field of donation. Prin urmare, lucrurile nu stau mai bine nici în terminologia juridică: unii spun că donația este o liberalitate, alții că este un contract, unii afirmă că cadoul nu este altceva decât o donație, alții că și bacșișul este o donație, ceilalți că premiile și recompensele, iar majoritatea susține că transplantul se face prin donare de organe și țesuturi și că sponsorizările sunt veritabile acte de donații, etc. Ce este interesant, că și alte contracte ce au drept scop majorarea patrimoniului altuia cu titlu gratuit, de asemenea sunt considerate categorii ale contractului de donație, deși ele sunt acte distincte, de liberalitate. De multe ori este echivalată donația cu contractul de donație, cu liberalitatea, iar liberalitatea cu gratificarea, iar actele cu titlu gratuit dezinteresate (depozitul gratuit, comodatul, împrumutul gratuit, uzufructul gratuit) se confundă cu donația. Mai mult, un șir de acte (bacșișul, discountul, premiul etc.) care, în aparență, sunt de gratificare, în esența lor reprezintă categorii de fapte de generozitate care nu se încadrează în sfera instituției donației, fiind confundate cu instituții reglementate de dreptul muncii în contextul unor varietăți de remunerare sau a dreptului afacerilor, în planul realizării activităților de marketing etc. Din aceste considerente, în compartimentul de față am decis să venim cu unele clarificări, atât cât e posibil, pentru a așeza la locul lor toți termenii care, de fapt, ar trebuie să intituleze diferite instituții, cu scopuri și trăsături proprii. În contextul dat, și legiuitorului i-ar fi mai ușor să reglementeze distinct toate aceste instituții care, deși sunt liberalități, gratifică pe cineva, însă prezintă trăsături distincte, fiind aplicate pentru situații, interese și efecte diferite. Astfel, în textul ce urmează vom analiza toți termenii ce intitulează domeniile distincte ale actelor și instituțiile de gratificare, dar vom prezenta și trăsături specifice pentru fiecare în materie de reglementare și stabilire a direcțiilor concrete de aplicare. De asemenea, cu toate că în conținutul altor lucrări am făcut distincția între donație și actele de gratificare aflate în afara câmpului juridic al donației, în lucrarea de față vom veni cu anumite compleis far from correct and not appropriate from a legal point of view, but also semantically. Often, the donation is equated with the donation contract, the donation with liberality, liberality with gratification or disinterested gratuitous acts (free deposit, commodation, free loan, free usufruct) with the donation. Moreover, a series of acts (tips, discounts, prizes, etc.) that, apparently, are gratuitous, in their essence represent categories of acts of generosity that do not fall within the scope of the donation institution, being confused with institutions regulated by labor law in the context of some varieties of remuneration or business law, in the plan of carrying out marketing activities, etc. For these reasons, in this section we have decided to provide some clarifications, as much as possible, in order to put in their place all the terms that, in fact, should name different institutions, with their own purpose and characteristics. In this context, it will also be easier for the legislator to regulate distinctly all these institutions that, although they are liberalities, gratify someone, but present distinct characteristics, are applied for different situations, interests and effects. Thus, in the following text we will analyze all the terms that name the distinct areas of the acts and the institutions of gratification, but we will also present specific characteristics for each one in terms of regulation and establishing concrete directions of application. Also, although in the content of other works we have distinguished between donation and acts of gratification outside the legal

Scopul articolului este de a aduce la cunoștința publicului, legiuitorului, precum și celor ce aplică legea, faptul că nu toate actele de gratificare sunt donații, respectiv urmează a fi tratate diferit, cu aplicarea legislației în privința lor în mod corespunzător fiecărei instituții, în funcție de scopurile și efectele sale. De asemenea, studiul urmărește formarea unei baze științifice solide și explicite, necesară legiuitorului în procesul reglementării actelor de gratificare. METODOLOGIE Metodele și materiale aplicate în cadrul cercetării se impun prin importanța și utilitatea lor teoretică recunoscută de veacuri, dintre aceste fiind utilizate cu preponderență: metoda analizei, metoda istorică, metoda sintezei, metoda deducției, metoda sistemică, metoda comparativă. DISCUȚII ȘI REZULTATE Pentru o mai bună consecutivitate necesară înțelegerii adevăratului sens al diferitor termeni, respectiv, pentru a elucida atribuțiile instituțiilor de drept și ale celor aflate în afara reglementării, vom sistematiza lucrarea în trei compartimente. Primul se va referi la unii termeni generali specifici instituției gratificării (generozitatea, altruismul și caritatea), al doilea la distincția donației de actele de generozitate aflate în afara instituției gratificării (bacșișul, premiile și recompensele, reducerile), iar în a treia parte vom analiza distincția între donație și liberalitățile aflate în afara câmpului juridic al donației (caritatea, darurile etc.). Generozitatea, altruismul și caritatea. Deși foarte apropiate după sens și esență, totuși între termenii de generozitate, altruism și caritate există o oarecare diferență. Evident, cea mai mare asemănare o identificăm între generozitate și altruism, ambele fiind niște stări și sentimente de afecțiune ce descriu o calitate a persoanei, care-i învăluie conștiința și o determină la fapte de gratificare în favoarea cuiva, fapte ce se materializează fie printr-un act de field of donation, in this work we will come with certain additions, but also with the presentation of the differences between acts of gratification, other than donation, and acts of generosity that do not even fall under the incidence of gratification itself. The purpose of the article is to bring to the attention of the public, the doctrine, the legislator, as well as those who apply the law, the fact that not all acts of gratification are donations, respectively, they are to be treated differently, as the legislation regarding them is applied appropriately to each institution depending on its purpose and effects. The study also aims to form a solid and explicit scientific basis necessary for the legislator in the process of regulating acts of gratification. METHODOLOGY The methods and materials applied in the research are established by their importance and theoretical utility recognized for centuries, among which the following are used with preponderance: the analysis method, the historical method, the synthesis method, the deduction method, the systemic method, the comparative method DISCUSSIONS AND RESULTS For a better consistency necessary to understand the true meaning of the different terms, respectively, legal institutions and those outside the regulation, we will systematize the work in three compartments. The first will refer to some general terms specific to the institution of gratification (generosity, altruism and charity), the second compartment will refer to the distinction of donation from acts of generosity outside the institution of gratification (tips, prizes and rewards, discounts), and in the third part we will analyze the distinction between donation and liberalities outside the legal field of donation (charity, gifts, etc.). Generosity, altruism and charity. Although very close in meaning and essence, there is a certain difference between the terms generosity, altruism and charity. Obviously, the greatest similarity is identified between generosity and altruism, both being states, feelings of affection that de-

În pofida acestui fapt, dacă generozitatea reprezintă un sentiment, o calitate a persoanei, ce constituie geneza oricărui act de gratificare liberalitate (diminuează patrimoniul dispunătorului), indiferent prin forma care se exprimă, atunci altruismul seamănă mai mult cu un sacrificiu ce se poate exprima nu neapărat prin tradițiune cu efecte de diminuare a patrimoniului dispunătorului în favoarea gratificatului, ci și printr-o activitate de ajutorare ce nu va înregistra efecte similare. Bunăoară, după cum susțin unii autori [13, p. 8], altruismul pur constă în a sacrifica ceva pentru altcineva în afară de sine – de exemplu, sacrificând timp, energie sau bunuri, fără a aștepta vreo compensație sau beneficiu, fie direct, fie indirect. În ce privește caritatea, deși se naște din generozitate, aceasta tot timpul este urmată de o acțiune îndreptată spre favorizarea materială a beneficiarului ei, instituție pe care o vom descrie într-un subiect ulterior. Distincția donației de actele de generozitate aflate în afara instituției gratificării. În percepția societății, toate actele și faptele prin care se transmit anumite bunuri gratuit și necondiționat constituie donații, iar în percepția dreptului lucrurile stau altfel. Deși în aparență, toate aceste acte sunt de gratificare, în sens juridic, dar și faptic, nu toate întrunesc semnele gratificării care, de fapt, sunt specifice și donației. Spre exemplu, deși prin transmiterea unui organ sau țesut de la o persoană sănătoasă către un pacient nu se urmărește un avantaj patrimonial, totuși aici nu suntem în prezența unui act de gratificare, odată ce obiectul acestuia nu se încadrează în categoria de bunuri, respectiv prin acesta nu se procură un folos patrimonial pacientului, ci unul vital. Or, potrivit art. 310 alin. 1 CC, act juridic cu titlu gratuit este actul prin care se procură unei părți un folos patrimonial fără a se urmări obținerea în schimb a unui alt folos patrimonial. De asemenea, cu toate că unele acte (bacșișul, premiile și recompensele, reducerile și discounturile), aparent gratuite, măresc patrimoniul beneficiarului acestora, fără a se urmări un avantaj patrimonial din partea disscribe a quality of the person, which envelops their conscience and determines them to acts of gratification in favor of someone, acts that materialize, either through an act of charity, or through an act of donation or even through an act that does not provide a patrimonial benefit to its recipient [9, p. 24]. Despite this fact, if generosity represents a feeling, a quality of the person, which constitutes the genesis of any act of gratification liberality (it decreases the patrimony of the donor), regardless of the form in which it is expressed, then altruism is more like a sacrifice that can be expressed not necessarily through tradition with effects of diminishing the patrimony of the donor in favor of the gratified, but also in a helping activity that will not register similar effects. For example, as some authors argue [13, p. 8],, pure altruism consists of sacrificing something for someone else besides oneself – for example, sacrificing time, energy or goods, without expecting any compensation or benefit, either directly or indirectly. As for charity, although it is born from generosity, it is always followed by an action aimed at materially favoring its beneficiary, an institution that we will describe in a later topic. The distinction between donation and acts of generosity outside the institution of gratification In the perception of society, all acts and deeds by which certain goods are transmitted free of charge and unconditionally constitute donations, while in the perception of law things are different. Although apparently, all these acts are gratification, in the legal sense, but also in fact, not all of them meet the signs of gratification which, in fact, are also specific to donation. For example, although by transmitting an organ or tissue from a healthy person to a patient a patrimonial advantage is not sought, however, here we are not in the presence of an act of gratification, since its object does not fall into the category of goods, respectively, through it a patrimonial benefit is not obtained for the patient, but a vital one. Or, according to art. 310 para. 1 CC, a gratuitous legal act is the act by which a patrimonial benefit is obtained for a party without seeking to obtain another patrimonial benefit in return. Ştiinţe Juridice// Legal Sciences, nr. 21/ 2025, ISSN 1857-0976, E-ISSN 2953-6898 41 punătorului, în sinea lor totuși urmăresc un folos patrimonial (creșterea volumului vânzărilor, eficienței muncii, etc.) sau remunerează o activitate ce depășește atribuțiile angajatului, din contul clientului angajatorului. În consecutivitatea respectivă, înainte de a trece la actele de gratificare aflate în afara câmpului juridic al donației, vom prezenta toate actele de generozitate care nu se află în sfera actelor de gratificare, nemaivorbind de donație. Bacșișul. În conținutul uneia dintre distinsele sale lucrări, autorul francez G. LyonCaen [14, p. 301] arată că bacșișul este o sumă de bani dată salariatului de către un terț, străin contractului de muncă, dar client al angajatorului. Deși, în acest context, s-ar observa în bacșiș o liberalitate pură, în același timp respectiva opinie se lovește de obiecția că, cel mai frecvent, plata bacșișului (după anumite legislații) este obligatorie și rezultă dintr-o majorare a facturii. În consecință, bacșișul rămâne a fi examinat în calitate de salariu sau un adaos la salariu (în viziunea multor angajatori) acoperit de persoane, altele decât angajatorul (clienții angajatorului). Așadar, fiind perceput, în aparență, drept donație remuneratorie, bacșișul reprezintă o formă de exprimare a generozității în schimbul unei prestații ce depășește limitele celei ce se cuvine în temeiul unui raport ce are, de obicei, ca obiect deservirea unui client. Prin urmare, deși clientul oferă un bacșiș distinct de plata serviciului prestat, totuși acesta nu se încadrează în categoria liberalităților, a actelor de gratificare, dar nici a donațiilor atâta timp cât este determinat de o contraprestație legată de serviciul la care presupusul gratificat este obligat [8, p. 22]. După cum susțin unii autori autohtoni [12, p. 97], bacșișul se bazează pe existența unui serviciu cu conținut patrimonial, însă nu corespunde în fond unei intenții liberale, reprezentând un gest non-juridic de compensare a unui serviciu s-a beneficiat. Acesta se achită separat de plata serviciului prestat, nu formează un supliment al remunerației și reprezintă o răsplată a muncii și atitudinii amabile, prompte a prestatorului, având o valoare rezonabilă. Premiile și recompensele. Tipping. In the content of one of his distinguished works, the French author, G. Lyon-Caen [14, p. 301], shows that the tip is a sum of money given to the employee by a third party, foreign to the employment contract, but a client of the employer. Although, in this context, a pure liberality would be observed in the tip, at the same time, that opinion runs into the objection that, most frequently, the payment of the tip (according to certain legislation) is mandatory and results from an increase in the bill. Consequently, the tip remains to be examined as a salary or an addition to the salary (in the view of many employers) covered by persons other than the employer (the employer’s clients). Therefore, being perceived, apparently, as a remunerative donation, the tip represents a form of expression of generosity in exchange for a service that exceeds the limits of what is due under a relationship that usually has as its object the service of a client. Therefore, although the client offers a tip distinct from the payment for the service provided, it does not fall into the category of liberalities, even more so of donations as long as it is determined by a counter-performance related to the service to which the alleged gratified person is obliged [8, p. 22]. As some local authors argue [12, p. 97], the tip is based on the existence of a service with patrimonial content, but it does not correspond in essence to a liberal intention, it represents a non-legal gesture of compensation for a service received. It is paid separately from the payment for the service provided, does not form a supplement to the remuneration and represents a reward for the work and kind,
Anale Știinţifice ale Academiei „Ştefan cel Mare” a MAI al Republicii Moldova Scientific Annals of the Academy “Stefan cel Mare” of MIA of the Republic of Moldova 42 se definește premiul în dicționarul explicativ al limbii române, constatăm că acesta nu este altceva decât o recompensă materială sau distincție acordată cuiva pentru merite şi succese deosebite obținute într-un domeniu de activitate, la un concurs, etc. Înainte de toate, având în vedere că, de multe ori, și în percepția curentă premiul este echivalat cu recompensa, pentru a verifica dacă lucrurile stau la fel și în materie juridică, am recurs la interpretarea normei de la art. 138 al Codului muncii [3], unde se menționează că pe lângă plățile prevăzute de sistemele de salarizare, pentru salariații unității se poate stabili o recompensă în baza rezultatelor activității anuale din fondul format din beneficiul obținut de unitate. Prin urmare, identificând în textul normei citate sintagma „poate” deducem că premiul sau recompensa au în comun faptul că ambele presupun o formă de remunerare a performanțelor pentru o anumită activitate prestată și care depinde doar de voința dispunătorului, fără a fi confundată cu salariul, care este un mijloc de retribuire a muncii. Acesta din urmă reprezintă o obligație a angajatorului raportată la dreptul salariatului (art. 131 CM - orice salariat are dreptul la un salariu minim garantat). Așadar, în această consecutivitate a analizei, constatăm că premiul, ca și recompensa, constituie o formă de stimulare și nu o obligație, respectiv nu este un act de gratificare specific donației, ci mai mult un act generos din partea angajatorului ascuns sub un supliment al remunerării. Or, potrivit art. 137 din Codul Muncii, angajatorul este în drept să stabilească diferite sisteme de premiere, de adaosuri și sporuri la salariul de bază, alte plăți de stimulare după consultarea reprezentanților salariaților. Deci, după cum se observă, am recurs la o interpretare mai detaliată pentru a arăta că premiul constituie un act material volitiv care vine să mărească patrimoniul salariatului, dar care urmărește în același timp stimularea acestuia tot în beneficiul angajatorului, cu atât mai mult că acesta se plătește, de obicei, după înregistrarea performanței în activitate, performanță ce avantajează angajatorul (dispunătorul). În speță, constatăm că partea ce excede volumul muncii la care se obligă salariatul prompt attitude of the provider, having a reasonable value. Awards and rewards. Consulting, in the absence of a legal notion, the text defining the award in the explanatory dictionary of the Romanian language, we find that it is nothing more than a material reward or distinction granted to someone for merits and special successes obtained in a field of activity, in a competition, etc. First of all, given that, often, even in the current perception, the award is equated with the reward, in order to verify whether things are the same in legal matters, we resorted to the interpretation of the norm in art. 138 of the Labor Code [3], which states that in addition to the payments provided for by the salary systems, a reward can be established for the employees of the unit based on the results of the annual activity from the fund formed by the benefit obtained by the unit. Therefore, identifying in the text of the cited norm the phrase «may» we deduce that the prize or reward have in common the fact that both involve a form of remuneration for performance for a certain activity performed and which depends only on the will of the person in charge, without being confused with the salary, which represents a means of remuneration for work. The latter represents an obligation of the employer related to the employee’s right (art. 131 CM - any employee has the right to a guaranteed minimum salary). Therefore, in the respective sequence of the analysis, we find that the prize, along with the reward, constitutes a form of incentive and not an obligation. Or, according to art. 137 of the Labor Code, the employer is entitled to establish different systems of awards, additions and bonuses to the basic salary, other incentive payments after consulting the employee representatives. So, as can be seen, we have resorted to a more detailed interpretation to show that the award constitutes a material volitional act that comes to increase the employee’s assets, but which at the same time aims to stimulate them for the benefit of the employer, especially since it is usually paid after recording performance in the activity, performance that benefits the employer (the person in charge). In this case, we find that the part that exceeds the volume of work to which the employee is obliged by the
Ştiinţe Juridice// Legal Sciences, nr. 21/ 2025, ISSN 1857-0976, E-ISSN 2953-6898 43 prin contractul individual de muncă este remunerată de către angajator prin acordarea premiului, deci în mod ipotetic identificăm o contraprestație, fapt care ne dă temei să excludem premiul și recompensa din câmpul juridic al donației, odată ce dispare elementul de gratificare, dar și cel de liberalitate. Aici se mai cuvine a menționa că acordarea premiului depinde exclusiv de voința dispunătorului și nu constituie o obligație impusă prin lege, fapt ce indică la existența unei obligații pur naturale, executarea căreia nu poate fi cerută pe calea acțiunii în justiție, ceea ce ne demonstrează încă o dată că premiile și recompensele nu sunt donații, acestea fiind percepute greșit din partea celor ce beneficiază de ele. Prin urmare, având în vedere că termenul utilizat „premiu” este impropriu naturii și conținutului juridic la care se referă, s-ar sugera substituirea acestuia cu alți termeni sau sintagme cum ar fi: „adaos salarial” sau „plată stimulatorie” etc. [8, p. 23]. De altfel, identificăm aceeași opinie și la unii autori români [11, p. 403], care s-au remarcat prin contribuția lor de-a lungul multor decenii în vederea promovării și dezvoltării doctrinei în materie. Reducerile și discounturile. Deși după particularitatea lor măresc, prin economisire, patrimoniul celui ce beneficiază de ele, acestea nu sunt considerate veritabile donații atâta timp cât prin stabilirea lor se urmărește obținerea unui avantaj patrimonial din partea dispunătorului, cu atât mai mult că nu diminuează în niciun fel patrimoniul său. Spunem aceasta, intenționând a scoate în evidență ideea că oricare ar fi mărimea reducerilor, acestea niciodată nu vor afecta valoarea reală a bunului, cu alte cuvinte se va opri la linia ce delimitează valoarea reală a bunului de profitul pretins. Totodată, pentru ca reducerea să fie calificată drept donație, ea trebuie să urmărească mărirea patrimoniului donatarului din contul patrimoniului existent, actual și real al donatorului și nu cel pe care și l-ar imagina sau s-ar aștepta a-l obține tot pe seama cumpărătorului (eventual donatar). Or, acest lucru, de fapt, se întâmplă în cazul reducerilor. Prin urmare, patrimoniul din care urmează să se mărească patrimoniul donatarului nu este actual, dar nici sigur că îl va avea în viitor, iar potrivit dispozițiilor art. 1198 alin. 2 CC, este nul contractul de donație, respectiv, prin analogie, orice act prin care se urmărește gratificarea, dacă prin acesta donatorul se obligă să transmită în viitor întreg patrimoniul actual sau o fracțiune din el fără a specifica bunurile care urmează să fie predate. Atribuirea reducerilor și discounturilor la categoria donațiilor, actualmente este ignorată și de jurisprudență, atenționându-se în unele Hotărâri ale Plenului CSJ [6] că reducerile, discounturile, cadourile, premiile sau câștigurile acordate de către agenții economici persoanelor fizice sau persoanelor juridice, de regulă își au motivația în promovarea vânzărilor, adică urmăresc obținerea în schimb a unui folos patrimonial, și nu sunt donații. Transplantul de țesuturi și organe. Cu toate că legislația în materie [5] operează cu noțiunea de „donație”, atunci când organele și țesuturile de organe constituie obiectul transplantului, considerăm, totuși, că acestea din urmă acte nu se califică drept veritabile donații. Și în genere, organele și țesuturile nu constituie obiecte ale dreptului de proprietate [12, p. 26], deci asupra lor nu pot fi exercitate drepturi patrimoniale, prin urmare nu constituie patrimoniul persoanei. Urmează aici să facem referire la formula destul de inspirată prin care se arată de ce corpul uman nu poate fi obiect al dreptului de proprietate. La baza acesteia stă principiul potrivit căruia dreptul nu acceptă un raport al persoanei fizice cu ea însăși. Astfel, eu nu sunt proprietatea corpului meu din moment ce corpul meu sunt eu. Corpul uman este substratul persoanei, el este persoana [17, p. 29]. Referindu-ne la acestea, constatăm că organele și țesuturile odată ce nu sunt bunuri și, prin urmare nu formează patrimoniul persoanei, prin transmiterea lor nu are loc mărirea patrimoniului celui ce a primit organul și nici nu diminuează patrimoniul celui ce a dispus de el. Transplantation of tissues and organs. Although the legislation in this field [5] operates with the notion of «donation», when organs and organ tissues constitute the object of transplantation, we nevertheless consider that the latter acts do not qualify as true donations. And in general, organs and tissues do not constitute objects of property rights [12, p. 26], so patrimonial rights cannot be exercised over them, therefore they do not constitute the person’s patrimony. Here we will refer to the rather inspired formula that shows why the human body cannot be the object of property rights. At its base is the principle according to which the law does not accept a relationship of the natural person with himself. Thus, I am not the property of my body since my body is me. The human body is the substratum of the person, it is the person [17, p. 29]. Referring to these, we note that since organs and tissues are not goods and, therefore, do not form the person’s patrimony, their transmission does not increase the patrimony of the person who received the organ nor does it diminish the patrimony of the person who disposed of it. Finally, we ask ourselves the question: will the norms regarding the revocability or nullity of donation be applicable in such relationships? Obviously not, leaving us with the

Totodată, deși s-ar părea că, dacă transplantarea unui organ de la o persoană la alta nu constituie un act de gratificare ce ar majora patrimoniu, respectiv diminua patrimoniul donatorului, odată ce acesta nu constituie un bun, ar constitui un act de gratificare dezinteresat, susținem că acest fapt nu se încadrează nici în categoria actelor dezinteresate. Or, cu toate că prin actele dezinteresate nu se micșorează patrimoniul dispunătorului (ex: o consultație gratuită), totuși acest serviciu poate fi evaluate pecuniar, deci are conținut patrimonial, așa că în cazul transplantului nu putem vorbi despre o prestație cu caracter patrimonial [8, p. 24]. Distincția între donație și liberalități aflate în afara câmpului juridic al donației. În viața de zi cu zi, adesea se produc acte materiale de gratificare care după natura și destinația lor, deși sunt de liberalitate, nu se încadrează în câmpul juridic al donațiilor și, respectiv, nu se materializează prin contracte de donație, fiind vorba de cadouri (daruri neînsemnate). Înainte de a trece la examinarea detaliată a subiectelor în discuție, considerăm necesar a face o remarcă chiar de la început, prin care să arătăm că toate aceste acte materiale de gratificare nu au decât să genereze pentru dispunător obligații naturale (imperfecte), ce nu se bucură de susținere din partea forței coercitive a statului [7, p. 152], fapt ce nu este specific actelor juridice, cu atât mai mult donației. În acest sens, se mai afirmă că intenția liberală lipsește și în cazul executării benevole a unei obligații civile imperfecte [10, p. 111]. Caritatea (filantropia și sponsorizarea) și donația. La compartimentul liberalităților, am început cu delimitarea între termenii „donație” și „caritate”, fiind deranjați de paradoxul în care, deși între aceștia există deosebiri esențiale, anume ei sunt confundați cel mai frecvent. Consultând dicționarul explicativ al limbii române, pentru a vedea explicația dată termenului de „caritate”, observăm că acesta nu are nimic comun cu donația, termenul respectiv nu se găsește în niciunul din contextele în care se explică semnificația carității, chiar nici sinonim nu este cu aceasta (caritate – binefacere, filantropie, milă). Before moving on to a detailed examination of the subjects under discussion, we consider it necessary to make a remark right from the beginning, by which we show that all these material acts of gratification have nothing but to generate natural (imperfect) obligations for the disposer that do not enjoy support from the coercive force of the state [7, p. 152], a fact that is not specific to legal acts, much less to donations. In this sense, it is also stated that liberal intention is also missing in the case of the voluntary execution of an imperfect civil obligation [10, p. 111]. Charity (philanthropy and sponsorship) and donation In the liberalities section, we began with the delimitation between the terms «donation» and «charity» being disturbed by the paradox in which, although there are essential differences between them, they are most frequently confused, being considered synonyms. Consulting, out of interest, the explanatory dictionary of the Romanian language, to see the explanation given to the term «charity», we notice that it has nothing in common with donation, the respective term is not found in any
