विकलांग व्यक्तियों के मानवाधिकारों की रक्षा के लिए भारत में कानूनी प्रावधान: समस्याएँ और समाधान
Abstract
भारत में विकलांग व्यक्तियों की एक बड़ी संख्या अब भी अपने मूलभूत मानवाधिकारों से वंचित है। सरकार ने अनेक कानूनी प्रावधान और योजनाएँ लागू की हैं, परंतु ज़मीनी स्तर पर उनका क्रियान्वयन अभी भी चुनौतियों से भरा है। यह शोध पत्र वर्तमान स्थिति, कानूनी उपायों की समीक्षा, प्रमुख समस्याओं का विश्लेषण, और व्यवहार्य समाधानों को प्रस्तुत करता है ताकि विकलांग व्यक्तियों को सम्मान, समानता और स्वतंत्र जीवन सुनिश्चित हो सके। भारत में विकलांग व्यक्तियों के मानवाधिकारों की सुरक्षा हेतु संविधानिक प्रावधानों तथा विकलांग व्यक्तियों के अधिकार अधिनियम, 2016 जैसे विशेष कानूनों को लागू किया गया है। इन प्रावधानों का उद्देश्य शिक्षा, रोजगार, स्वास्थ्य और सामाजिक जीवन में समान अवसर उपलब्ध कराना है। इसके बावजूद, व्यावहारिक स्तर पर अनेक चुनौतियाँ बनी हुई हैं, जैसे—कानूनों का प्रभावी क्रियान्वयन न होना, सामाजिक पूर्वाग्रह, समावेशी शिक्षा एवं रोजगार की कमी, बाधारहित अवसंरचना का अभाव और अधिकारों के प्रति जागरूकता का न होना । इन समस्याओं के समाधान हेतु आवश्यक है कि कानूनों का कठोर अनुपालन सुनिश्चित किया जाए, सामाजिक दृष्टिकोण में सकारात्मक परिवर्तन लाया जाए, समावेशी शिक्षा एवं रोजगार को बढ़ावा दिया जाए, सार्वभौमिक रूप से सुगम अवसंरचना विकसित की जाए तथा विकलांग व्यक्तियों को कानूनी साक्षरता से सशक्त किया जाए। इस प्रकार ही उनके मानवाधिकारों की वास्तविक रक्षा और गरिमापूर्ण जीवन की स्थापना संभव हो सकेगी ।
