न्यायिक अतिक्रमण: लोकतांत्रिक शासन प्रणाली पर प्रभाव का सैद्धांतिक अध्ययन
Abstract
यह शोधपत्र भारत में न्यायिक अतिक्रमण (Judicial Overreach) और उसके लोकतांत्रिक शासन प्रणाली पर प्रभाव का सैद्धांतिक अध्ययन प्रस्तुत करता है। न्यायपालिका का संवैधानिक ढांचा लोकतंत्र में संतुलन बनाए रखने के लिए महत्वपूर्ण है, परन्तु कभी-कभी न्यायिक हस्तक्षेप अपने सीमित अधिकार क्षेत्र से आगे जाकर विधायिका और कार्यपालिका के क्षेत्रों में प्रवेश कर जाता है। इस शोध में न्यायिक अतिक्रमण की परिभाषा, ऐतिहासिक और वैचारिक आधार, तथा इसके सकारात्मक और नकारात्मक प्रभावों का विश्लेषण किया गया है। लेख में 2022–2023 के समकालीन भारतीय उदाहरणों जैसे Supreme Court Advocates-on-Record Association v. Union of India (2022), State of Tamil Nadu v. Governor of Tamil Nadu (2022) और कोविड-19 संबंधित PIL मामलों का अध्ययन किया गया है। शोध में न्यायिक सक्रियता और अतिक्रमण के बीच के अंतर को स्पष्ट करते हुए न्यायिक आत्मसंयम (Judicial Restraint) की आवश्यकता पर बल दिया गया है। अध्ययन में यह निष्कर्ष निकला है कि न्यायपालिका का लोकतांत्रिक प्रक्रिया में हस्तक्षेप तब ही न्यायोचित माना जा सकता है जब वह संवैधानिक अधिकारों की रक्षा और जनहित के संरक्षण के लिए आवश्यक हो। साथ ही, संतुलित दृष्टिकोण, पारदर्शिता और संस्थागत सुधार के माध्यम से न्यायपालिका और लोकतंत्र के बीच सामंजस्य स्थापित किया जा सकता है। यह शोध भारत में न्यायिक अतिक्रमण और लोकतांत्रिक शासन प्रणाली के बीच संतुलन बनाए रखने के लिए नीतिगत और संवैधानिक उपाय सुझाता है।
