सामाजिक न्याय और आरक्षण
Abstract
सामाजिक न्याय और राजनैतिक चिंतन में समानता (समतावाद) एक स्थापित अवधारणा हैं। सामाजिक न्याय की अवधारणा सभी मनुष्यों के समान मूल्य और नैतिक स्थिति की संकल्पना पर बल देता हैं, समतावाद का दर्शन ऐसी व्यवस्था का समर्थन करता है, जिसमें सम्पन्न और समर्थ व्यक्तियों के साथ-साथ निर्बल, निर्धन और वंचित व्यक्तियों को भी आत्मविश्वास के साथ आत्मविकास के लिए उपयुक्त अवसर और अनुकूल परिस्थितियाँ प्राप्त हो सकें। सही अर्थां में निष्पक्ष या पक्षपात रहित बर्ताव ही न्याय है। जब ऐसा व्यवहार समाज अपने सभी वर्गों-उपवर्गों के साथ करता है, तो उसे सामाजिक न्याय कहते हैं। सामाजिक न्याय के परम्परागत स्वरूप की तुलना जब आधुनिक भारतीय समाज में न्याय से करते हैं, तो पाते हैं कि परम्परागत समाज में जिसे न्याय समझा जाता था, वह आधुनिक सन्दर्भ में घोर अन्याय माना जाता है। परम्परात्मक न्याय जन्म, असमानता और भेदभाव पर आधारित था जबकि आधुनिक सामाजिक न्याय जन्म, धर्म, जाति की समानता, स्वतन्त्रता, मानव व्यक्तित्व की गरिमा की रक्षा पर बल देता है। जहां तक सामाजिक न्याय में आरक्षण की बात करें तो एक न्याय पूर्ण समाज व्यवस्था के विकास में सभी को समान रूप से अधिकार देने के लिए आरक्षण आवश्यक है। सामाजिक न्याय का सारतत्व ‘समता का सिद्धान्त’ है।
